VAT Registration in France for U.S. Companies

A U.S. company can have French VAT obligations even if it has not incorporated a French subsidiary or opened a permanent office in France.

Whether French VAT registration is required depends primarily on the transactions carried out in France, the location and VAT status of the customer, and the way goods or services are supplied.

When Does a U.S. Company Need French VAT Registration?

French VAT registration may be required when a foreign company carries out transactions such as certain sales taxable in France, intra-Community supplies or acquisitions, exports from France, imports subject to VAT reporting, or other transactions requiring a French VAT number.

When a foreign company supplies goods or services to a customer that is identified for VAT in France, the reverse-charge mechanism may apply, meaning that the customer accounts for the French VAT instead of the foreign supplier, according to the French tax authorities.

The VAT position must therefore be assessed according to the actual flow of goods or services rather than simply according to whether the U.S. company has a French legal entity.

French VAT obligations depend on the transactions carried out in France, not simply on whether the U.S. company has established a French subsidiary or branch.

French VAT Fiscal Representative for U.S. Companies

When a U.S. company without a permanent establishment in France is required to register for French VAT, it may also be required to appoint a French VAT fiscal representative.

France exempts businesses established in the European Union and in certain non-EU countries from this requirement. The United States is not included in the current French list of exempt non-EU countries. Where fiscal representation is required, the representative must be established in France and subject to French VAT.

The fiscal representative handles the VAT registration and related compliance obligations on behalf of the U.S. company and, where applicable, VAT payments or VAT credit refund procedures.

The requirement should therefore be reviewed before taxable transactions begin, taking into account the company’s activities and any applicable exceptions.

For U.S. companies, French VAT registration and fiscal representation should be reviewed together before starting taxable activities in France.
